Terms and Conditions

1. Scope

These General Terms and Conditions (Terms) apply to all orders placed through the online shop of Tortuga Vitalis AG (hereinafter "Tortuga Sense") at the domain tortuga-sense.com. By placing an order, you agree to these Terms.

3. Contract Formation

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By clicking the "Proceed to Payment" button, you submit a binding order. The purchase contract is concluded when we accept your order by sending you an order confirmation via email.

We reserve the right to reject orders without stating reasons, in particular in case of product unavailability, incorrect pricing, or reasonable suspicion of misuse.

4. Product Availability and Deliverability

All offers are valid "while stocks last", unless expressly stated otherwise. If an ordered product is not available, we will inform you immediately and offer you an equivalent replacement product if possible. If you reject the replacement product or we cannot offer a replacement, we will refund any payments you have already made in full.

We are entitled to make partial deliveries if this is reasonable for you. In this case, we will bear the additional shipping costs.

5. Prices and Payment Terms

All prices are in Swiss francs (CHF) and include the statutory value-added tax of 7.7%.

Shipping costs are displayed separately during the ordering process and must be paid by the customer.

Payment Methods: We accept the following payment methods:

Payment is made immediately upon order completion. The invoice amount will be debited from your chosen payment method immediately after order completion.

Pricing Errors: Obvious errors or mistakes in pricing entitle us to contest the contract. In this case, we will inform you immediately and offer you the product at the correct price.

6. Vouchers and Discount Codes

Vouchers and discount codes can only be redeemed within the scope of the applicable promotional terms. As a rule, only one voucher or discount code can be redeemed per order, unless expressly stated otherwise.

Vouchers are not transferable to other persons and cannot be exchanged for cash. Cash payment of remaining credit is excluded.

The validity period of vouchers is stated on the respective voucher. After the validity period expires, the voucher expires without replacement.

7. Retention of Title

The delivered goods remain our property until full payment of all claims arising from the business relationship. In case of breach of contract by the customer, in particular in case of payment default, we are entitled to reclaim the goods.

8. Delivery and Shipping

Delivery is exclusively within Switzerland via Swiss Post.

Delivery Time: 2-3 business days after payment receipt

Shipping Costs: CHF 7.50.–

Free Shipping: From an order value of CHF 100.–

The risk of accidental loss and deterioration passes to you upon handover to the shipping service provider.

Delivery Delay: If we are unable to meet the agreed delivery period, we will inform you immediately and provide you with a new delivery date. If the delay exceeds 30 days, you have the right to withdraw from the contract.

Acceptance Delay: If you do not accept the goods or are not reachable, we may charge you for any additional costs incurred (e.g., storage costs, redelivery). After unsuccessful second delivery, we are entitled to withdraw from the contract and charge you for the costs incurred.

9. Right of Withdrawal

You have the right to withdraw from this contract within 30 days without stating reasons.

The withdrawal period is 30 days from the day on which you or a third party designated by you took possession of the goods.

To exercise your right of withdrawal, you must inform us (Tortuga Vitalis AG, Griebachstrasse 17, 6300 Zug, Email: shop@tortuga-sense.com) by means of a clear statement of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient that you send the notice of exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal:

If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a different type of delivery than the cheapest standard delivery we offer), immediately and no later than 14 days from the day on which we received notice of your withdrawal from this contract.

For this refund, we will use the same payment method you used in the original transaction, unless you have expressly agreed otherwise. In no case will you be charged any fees for this refund.

We may refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than 14 days from the day you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the 14-day period expires.

You bear the direct costs of returning the goods.

You are only liable for any loss in value of the goods if this loss of value is due to handling of the goods that is not necessary for examining the nature, properties, and functioning of the goods.

Exclusion of Right of Withdrawal:

The right of withdrawal does not apply to goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. Opened or unsealed dietary supplements cannot therefore be returned.

10. Special Information on Dietary Supplements

Product Properties:

The dietary supplements offered are not a substitute for a balanced and varied diet and a healthy lifestyle. They serve to supplement normal nutrition.

Recommended Intake:

The recommended daily intake should not be exceeded. Please follow the intake recommendation on the product packaging.

Storage:

Store the products in a cool, dry place protected from light. Keep out of reach of children. After opening, the products should be consumed within the period specified on the packaging.

Shelf Life:

The best-before date (BBD) is indicated on each product package. We guarantee that all delivered products have a shelf life of at least 6 months at the time of delivery, unless otherwise stated.

Usage Instructions:

If you have health concerns, are pregnant, breastfeeding, or taking medications, please consult a doctor or pharmacist before use. Persons with known allergies should carefully check the ingredients.

Alcohol-Containing Products:

Some of our products contain alcohol as an extraction agent (up to 22% vol.). These products are not suitable for pregnant women, nursing mothers, or persons who must or wish to avoid alcohol for health or religious reasons.

Quality and Safety:

Our products are manufactured to the highest quality standards and regularly tested. All ingredients are listed on the product packaging. If you have questions about the composition or compatibility, please feel free to contact us.

Liability Disclaimer:

We assume no liability for damages caused by improper use, failure to follow product instructions, exceeding the recommended intake, or improper storage.

11. Warranty and Liability

The statutory warranty rights under Swiss Code of Obligations (OR) apply.

In case of defects, you are entitled to repair, replacement delivery, price reduction, or contract cancellation at your choice, as provided by law.

Please inspect the goods immediately upon receipt and report any defects immediately by email to shop@tortuga-sense.com. We will of course replace damaged or defective products free of charge.

Limitation of Liability:

We are liable without limitation for intent and gross negligence. For ordinary negligence, we are only liable for breach of essential contractual obligations (cardinal duties). In this case, liability is limited to foreseeable, contract-typical damages. Liability for personal injury remains unaffected.

12. Set-Off and Right of Retention

You have the right to set-off only if your counterclaims have been legally established or are undisputed. You may only exercise a right of retention to the extent that your counterclaim is based on the same contractual relationship.

13. Newsletter and Advertising

With your consent, we will regularly send you our newsletter with information about our products, offers, and news.

You can unsubscribe from the newsletter at any time by clicking the unsubscribe link in each newsletter email or by sending us an email at shop@tortuga-sense.com.

Unsubscribing from the newsletter does not affect the sending of transaction-related emails (e.g., order confirmations, shipping notifications).

14. Packaging Disposal

We are required under Swiss packaging regulations to accept packaging returns. You can return packaging to us. Alternatively, you can dispose of packaging at municipal collection points.

15. Data Protection

We process your personal data in accordance with the provisions of the Swiss Data Protection Act (DSG). For more information, please see our Privacy Policy.

16. Copyright

All content of this online shop (texts, images, graphics, logos) is protected by copyright and is the property of Tortuga Vitalis AG or our licensors. Any reproduction, distribution, or public display requires our express consent.

17. Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

18. Place of Performance and Jurisdiction

Place of Performance: The place of performance for all services under this contract is the registered office of Tortuga Vitalis AG in Zug.

Jurisdiction: Exclusive jurisdiction for all disputes arising from this contract is Zug, provided you are a merchant, legal entity under public law, or public law special assets.

19. Applicable Law

Swiss law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

20. Changes to the Terms

We reserve the right to change these Terms at any time. The amended Terms will be communicated to you by email or displayed on your next visit to our website. If you do not object to the amended Terms within 14 days of notification, the amended Terms are deemed accepted.

21. Severability Clause

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is not affected. An invalid provision will be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
